Final Order Entered: 1. Delta is authorized to issue long-term debt as described in its application in an amount up to $34 million, issued in two tranches in the amounts of $15.11 million and $18.89 million. 2. The proceeds from the transaction authorized herein shall be used only for the lawful purposes set out in the application. 3. Delta shall, within 30 days from the date of issuance, file with the Commission a statement setting forth the date or dates of issuance of the securities authorized herein; the price paid, the proceeds of such issuances, the interest rate, and all fees and expenses, including underwriting discounts or commissions or other compensation, involved in the issuance and distribution. Delta shall also file documentation showing the quotes that it relied upon to determine the lowest interest rate. 4. Any documents filed in the future pursuant to ordering paragraph 3 herein shall reference this case number and shall be retained in the post-case correspondence file. 5. This case is closed and removed from the Commission’s docket. Nothing contained herein shall be deemed a warranty or finding of value of securities or financing authorized herein on the part of the Commonwealth of Kentucky or any agency thereof.

Order Entered: 1. The procedural schedule set forth in the Appendix to this Order shall be followed. 2. Delta shall respond to all requests for information propounded by Commission Staff, whether identified on the procedural schedule or otherwise, as provided in those requests. 3. Any party filing a paper with the Commission shall file an electronic copy in accordance with the electronic filing procedures set forth in 807 KAR 5:001, Section 8. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. The Commission directs the parties to the Commission’s July 22, 2021 Order in Case No. 2020-00085 regarding filings with the Commission. 4. As set forth in 807 KAR 5:001, Section 4(11)(a), a person requesting permissive intervention in a Commission proceeding is required to demonstrate either (1) a special interest in the proceeding that is not adequately represented in the case, or (2) that the person requesting permissive intervention is likely to present issues or develop facts that will assist the Commission in fully considering the matter without unduly complicating or disrupting the proceedings. Therefore, any person requesting to intervene in a Commission proceeding must state with specificity the person’s special interest that is not otherwise adequately represented, or the issues and facts that the person will present that will assist the Commission in fully considering the matter.
