Order Entered: 1. A local public comment meeting for the purpose of hearing public comments shall be held on March 11, 2025, at 5 p.m. Eastern Daylight Time at Clay County Fiscal Court, 102 Richmond Road #201 Manchester, Kentucky 40962 and continuing until called from the bench by the presiding officer. 2. No evidence shall be taken at the local public hearing. 3. Recordings of the in person public comment meeting will be filed into the record of this case. 4. Delta shall provide written notice of the time and place of the local public hearing pursuant to 807 KAR 5:001, Section 9(2). 5. Within 20 days after publication, Delta shall file proof of publication in the file. 6. Delta shall ensure that a representative(s) is present at the public meetings.

Order Entered: 1. A hearing in this matter shall be held on April 17, 2025, beginning at 9 a.m. Eastern Daylight Time, and continuing until called from the bench by the presiding officer, in the Richard Raff Hearing Room at the offices of the Public Service Commission at 211 Sower Boulevard, Frankfort, Kentucky. 2. Pursuant to 807 KAR 5:001, Section 2, if the hearing is not concluded on the designated day, the hearing may be continued upon verbal announcement by the presiding officer. A verbal announcement made by the presiding officer shall be proper notice of the continued hearing. 3. Witnesses who sponsor schedules, testimony, or responses to requests for information shall participate in person at the April 17, 2025 hearing except as set out below. 4. Pursuant to the Order issued January 9, 2025, Richard Baudino shall appear virtually. Commission Staff should arrange a technological test at least three days prior to the hearing with the Attorney General’s Office and Mr. Baudino. 5. All parties shall file a witness list at least seven days prior to the hearing date.

Order Entered: 1. The procedural schedule set forth in the Appendix to this Order shall be followed. 2. The informal technical conference shall be held in person on December 17, 2024 at 1 p.m. Eastern Standard Time. 3. Delta shall respond to all requests for information propounded by Commission Staff, whether identified on the procedural schedule or otherwise, as provided in those requests. 4. Any party filing a paper with the Commission shall file an electronic copy in accordance with the electronic filing procedures set forth in 807 KAR 5:001, Section 8. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. The Commission directs the parties to the Commission’s July 22, 2021 Order in Case No. 2020-00085 regarding filings with the Commission.

Order Entered: 1. The Attorney General’s motion to intervene is granted. 2. The Attorney General is entitled to the full rights of a party and shall be served with the Commission’s Orders and with filed testimony, exhibits, pleadings, correspondence, and all other documents submitted by parties after the date of this Order. 3. The Attorney General shall comply with all provisions of the Commission’s regulations, 807 KAR 5:001, Section 8, related to the service and electronic filing of documents.
