Order Entered: 1. Northern Kentucky District’s motion is denied. 2. Northern Kentucky District shall file a new application pursuant to KRS 278.300 for approval of financing in connection with the CPCN granted for the construction project specified in the Commission’s April 6, 2021 Order. The CPCN granted in the Commission’s April 6, 2021 Order remains valid and Northern Kentucky District is not required to re-file for approval of the CPCN. 3. Order Entered: 1. Northern Kentucky Water’s petition for confidential treatment is granted. 2. The designated material granted confidential treatment by this Order shall not be placed in the public record or made available for public inspection for an indefinite period or until further Order of this Commission. 3. Use of the designated material granted confidential treatment by this Order in any Commission proceeding shall comply with 807 KAR 5:001, Section 13(9). 4. Northern Kentucky Water shall inform the Commission if the designated material granted confidential treatment by this Order becomes publicly available or no longer qualifies for confidential treatment. 5. If a nonparty to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, Northern Kentucky Water shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Northern Kentucky Water is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.

Final Order Entered: 1. Northern Kentucky District is granted a CPCN to proceed with the proposed construction of Phase II of the improvements at the Fort Thomas Plant and the Taylor Mill Plant as set forth in its application. 2. Northern Kentucky District shall notify the Commission prior to performing any additional construction not expressly authorized by this Order. 3. Any deviation from the approved construction shall be undertaken only with the prior approval of the Commission. 4. Northern Kentucky District shall require construction to be inspected under the general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with the best practices of the construction trades involved in the project. 5. Northern Kentucky District is authorized to supplement the executed Assistance Agreement with KIA and, under the terms of that Agreement, to borrow from KIA an amount not to exceed $3,395,000 to be repaid over a 20-year period at an interest rate of 1.75 percent per annum and loan servicing fee of 0.25 percent per annum. 6. Northern Kentucky District shall submit an application to the Commission prior to issuing any securities that require approval pursuant to KRS 278.300.
