Within 20 days of the date of service of this Order, Breathitt District shall publish, in a newspaper of general circulation in Breathitt County, a second notice of the vacancy on Breathitt District’s Board attached as an Appendix hereto. 2. Within five days of the publication, Breathitt District shall supply proof of publication to the Commission. 3. Within 20 days of the date of publication, any person who wishes to apply as a candidate to fill the vacancy on Breathitt District’s Board shall submit to the Commission, in writing, via electronic mail, their name, address, telephone number, qualifications, and should reference Case No. 2020-00398. 4. The term of the commissioner appointed shall be four years from the end of the term, which is now vacant pursuant to KRS 74.020. 5. The Executive Director shall serve a copy of this Order upon the Breathitt County Judge/Executive, the members of the Breathitt County Fiscal Court, and Breathitt District's Board.

Order Entered: 1. This proceeding is initiated to determine whether a vacancy existed on the Breathitt District’s Board for more than 90 days. 2. Breathitt District is made a party to this proceeding. 3. The information requested in the Appendix to this Order is due within 14 days of the entry of this Order. a. Responses to requests for information shall be appropriately bound, tabbed and indexed, with the original and an electronic version to the Commission. The Commission expects the original documents to be filed with the Commission within 30 days of the lifting of the current state of emergency. Electronic documents shall be in portable document format (PDF), shall be searchable, and shall be appropriately bookmarked. Each response shall include the name of the witness responsible for responding to the questions related to the information provided. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or an association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person’s knowledge, information, and belief formed after a reasonable inquiry.
