Order Entered: 1. Duke's petition for confidential protection for Responses 1, 5, 6, 9, and 25 and Second Response No. 3 is granted. These items shall not be placed in the public record or made available for ten years, or until further Orders of this Commission. 2. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 3. Duke shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 4. If a non-party to this proceeding requests to inspect the material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, then Duke shall have 20 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Duke is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 5. The Commission shall not make the requested material available for inspection for 20 days following an Order finding that the material no longer qualifies for confidential treatment in order to allow Duke to seek a remedy afforded by law. |

Order Entered, nunc pro tunc, that: 1. The Appendix to the July 31 , 2017 Order is replaced with the Appendix attached to this Order. 2. All other provisions of the Commission's July 31, 2017 Order not in conflict with this Order shall remain in full force and effect. |

Final Order Entered: 1. The charges and credits applied by Duke Kentucky through the FAC for the period from November 1, 2014, through October 31 , 2016, are approved. 2. Duke Kentucky's proposed base fuel cost of $.023837 per kWh is approved. 3. Duke Kentucky shall reduce its base energy rates by $.005280 per kWh to reflect the re-establishment of base fuel costs. 4. The rates in the Appendix to this Order are approved effective with Duke Kentucky's first billing cycle for September 2017. 5. Beginning with the expense month for September 2017, Duke Kentucky shall use a FAC rate based upon a base fuel cost of $.023837 per kWh. 6. Within 20 days of the date of this Order, Duke Kentucky shall file, using the Commission's electronic Tariff Filing System, its revised tariff sheets with the Commission setting out the rates approved herein and reflecting that they were approved pursuant to this Order. |

Order Entered: 1. Duke Energy Kentucky, Inc. ("Duke Kentucky") shall appear in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, on April 18, 2017, at 9:00 a.m., Eastern Daylight Time, to submit itself to examination on the application of its Fuel Adjustment Clause ("FAC") from November 1, 2014, to October 31, 2016. 2. Not less than seven days nor more than 21 days prior to the scheduled hearing, Duke Kentucky shall publish in a newspaper of general circulation in each area in which it provides service notice of the purpose, time, place, and date of the scheduled hearing. 3. Duke Kentucky shall file with the Commission no later than April 17, 2017, proof of publication of its notice for the hearing. 4. The Commission adopts the procedural schedule set forth in Appendix A to this Order, which is incorporated by reference herein. 5. a. Duke Kentucky shall file with the Commission, on or before February 20, 2017, its responses to all requests for information listed in Appendix B. |
