Order Entered: 1. An IC shall be held on Thursday, September 29, 2016, at 11:00 a.m. Eastern Daylight Time, at the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky. 2. The remaining requests contained in North Mercer's Motion are held in abeyance until further Order of the Commission.

Order Entered, nunc pro tunc, that: 1. Ordering paragraph 1 of the Order entered on September 9, 2016, is corrected to reflect that "North Mercer shall appear on Thursday, October 13, 2016, at 9:00 a.m. Eastern Daylight Time, in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, to show cause, if any, why it should not be subject to penalties pursuant to KRS 278.990 for failure to satisfy the matters complained of or file a written answer to the complaint in Case No. 2016-00154, as required by 807 KAR 5:001, Section 20(6), and the Commission's Orders entered April 21, 2016, and June 10, 2016, in that case." 2. All other provisions of the Commission's Order entered on September 9, 2016, shall remain in full force and effect.

North Mercer Water District Request for IC and Motion for Stay

Order Entered: 1. North Mercer shall appear on Thursday, October 13, 2016, in Hearing Room 1 of the Commission's offices at 211 Sower Boulevard, Frankfort, Kentucky, to show cause, if any, why it should not be subject to penalties pursuant to KRS 278.990 for failure to satisfy the matters complained of or file a written answer to the complaint in Case No. 2016-00154, as required by 807 KAR 5:001, Section 20(6), and the Commission's Orders entered April 21, 2016, and June 10, 2016, in that case. 2. Pursuant to KRS 278.360 and 807 KAR 5:001, Section 9(a)a, the record of the formal hearing shall be recorded by videotape only. 3. The record of Commission Case No. 2016-00154 is made a part of the record by reference only. 4. Any request for an informal conference with Commission Staff to discuss the issues in this case shall be set forth in writing and filed with the Commission within 20 days of the date of this Order.
