Final Order Entered: 1. Crittenden-Livingston is granted a CPCN to proceed with the proposed construction as set forth in its application. 2. Crittenden-Livingston shall notify the Commission prior to performing any additional construction not expressly authorized by this Order. 3. Any deviation from the construction approved by this Order shall be undertaken only with the prior approval of the Commission. 4. Crittenden-Livingston shall require construction to be inspected under the general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with the best practices of the construction trades involved in the project. 5. Crittenden-Livingston is authorized to enter the proposed Assistance Agreement with KIA and, under the terms of the Assistance Agreement, to borrow from KIA an amount not to exceed $1 ,039,500 to be repaid over a 20-year period at an interest rate of 1.75 percent per annum with a loan servicing fee of 0.25 percent of the annual outstanding loan balance payable to KIA with each interest payment. 6. Within 30 days of executing its proposed Assistance Agreement with KIA, Crittenden-Livingston shall file with the Commission an executed copy of the Assistance Agreement. |

Order Entered: 1. Crittenden-Livingston's Motion to Amend is granted. 2. Ordering paragraph 3 of the Commission's August 9, 2016 Order is amended to the limited extent that Crittenden-Livingston shall file only one copy of the plans, specifications, and drawings of its proposed water storage facility in paper medium. 3. All provisions of the Commission's August 9, 2016 Order that are not in conflict with this Order shall remain in full force and effect. 4. Crittenden-Livingston's Application is considered filed as of the date of this Order. |
