Final Order Entered: 1. The designation of lnfiniti Mobile as a limited ETC is conditioned on lnfiniti Mobile's compliance with: (1) the representations and commitments made by lnfiniti Mobile in its ETC application and its Compliance Plan; and (2) the FCC rules, including those adopted by the FCC in the Lifeline Reform Order. 2. lnfiniti Mobile is designated as a limited ETC for the purpose of offering Lifeline service only in the underlying carrier's non-rural licensed service area in Kentucky. 3. During the current certification period, lnfiniti Mobile shall be eligible to receive federal USF and state support for Lifeline. 4. lnfiniti Mobile shall advertise the availability of and charges for these services using media of general distribution. 5. lnfiniti Mobile shall comply with the FCC's annual certification process for Lifeline customers. 6. lnfiniti Mobile is a utility under the definitions contained in KRS 278.010(3) and shall include revenue generated from the sale of intrastate wireless service, including Lifeline revenues, in its reports filed pursuant to KRS 278.140. 7. A copy of this Order shall be served upon the FCC and the USAC. 8. Within 30 days of the date of this Order, lnfiniti Mobile shall file proof with the Commission showing that it meets the minimum minute requirements for the provision of Lifeline voice service.

Order Entered: 1. lnfiniti Mobile's petition for confidential protection for designated material contained in its response to Staffs Second Request. Item 5, is granted. 2. The designated material set forth in lnfiniti Mobile's response to Staffs Second Request, Item 5, shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. lnfiniti Mobile shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect material granted confidential treatment by this Order and the period during which the material has been granted confidential treatment has not expired, then lnfiniti Mobile shall have 20 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61 .878. If lnfiniti Mobile is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection.
