Order Entered: 1. KU and LG&E's September 6, 2016 petition for confidential protection is granted. 2. The designated materials shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. KU and LG&E shall inform the Commission if the designated materials become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect the designated materials and the period during which the materials have been granted confidential treatment has not expired, KU and LG&E shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If KU and LG&E is unable to make such demonstration, the designated materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the designated materials available for inspection for 30 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow KU and LG&E to seek a remedy afforded by law. |

Order Entered: The November 4, 2016 Order is amended to the limited extent that the table on page 8 should reflect the Solar Energy Credits for the Residential, Volunteer Fire Department, Residential Time-of-Day Energy, and Residential Time-of-Day Demand as being $0.03477 for KU and $0.04020 for LG&E. 2. All other provisions of the November 4, 2016 Order that are not in conflict with the terms of this Order shall remain in full force and effect. |

Final Order Entered: 1. The proposed Rider SSP tariff, as revised through discovery, is approved for service rendered on and after the date of this Order. 2. The Companies' request to apply the Commission-approved Brown Solar Facility depreciation rates to the proposed Solar Share Facilities is approved. 3. The proposed four-MW Solar Share Facilities are properly classified as an ordinary extension of existing systems in the usual course of business, and pursuant to KRS 278.020(1 ), a CPCN shall not be required for its construction. The Companies are to notify the Commission within 30 days each time that an additional 500-kW Solar Share Facility is fully subscribed. 4. The Companies shall file annual reports for three years with the Commission, as proposed and as discussed herein, and shall include the number of Solar Share Facilities constructed, current participation levels, and other relevant information. The first annual report shall be filed one year from the date of this Order, and annually on this date thereafter. 5. The Companies' joint motion to submit the matter for a decision on the record is granted. 6. Within 20 days of the date of this Order, the Companies shall file with this Commission, using the Commission's electronic Tariff Filing System, revised Rider SSP tariffs reflecting that they were approved pursuant to this Order. |

Order Entered: 1 . The Companies' proposed Rider SSP tariffs are suspended for five months from September 1, 2016, up to and including January 31, 2017. 2. The Companies' request for a deviation from the requirements of 807 KAR 5:011 , Section 8, to publish customer notice three times is denied and a deviation is granted to allow the Companies to publish the customer notice only one time. 3. The procedural schedule set forth in the Appendix to this Order shall be followed. 4 . a. Responses to requests for information in paper medium shall be appropriately bound, tabbed, and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided, with an original and six copies in paper medium and an electronic version to the Commission. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person's knowledge, information, and belief formed after a reasonable inquiry. c. Any party shall make timely amendment to any prior response if it obtains information which indicates that the response was incorrect when made or, though correct when made, is now incorrect in any material respect. |
