Order Entered: 1. EKPC's motion for confidential protection is granted. 2. The designated materials, with the exception of the material in Section 11.0 of the IRP, shall not be placed in the public record or made available for public inspection for a period of 15 years from the date of this Order, or until further Orders of this Commission. The material in Section 11.0 of the IRP shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the materials that were granted confidential treatment in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. EKPC shall inform the Commission if the materials granted confidential treatment become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not run, then EKPC shall have 20 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If EKPC is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. |

EKPC's motion for confidential protection is hereby denied. 2. Within seven days of the date of this Order, EKPC shall file a revised version of the materials on Table 1-3 on page 1-9, Table 8-2 on page 8-9, Section 3.2.3 on page 3-6, Figure 8-1 on page 8-2, Figure 8-2 on page 8-3 of the attachment to EKPC's response to Staff's Supplemental Request, Item 6, for which confidential protection was denied, reflecting as underacted the information that has been denied confidential treatment. The materials for which EKPC request for confidential treatment has been denied shall neither be placed in the public record nor made available for inspection for 33 days from the date of this Order in order to allow EKPC to seek a remedy afforded by law. |

Order Entered: 1. The procedural schedule set forth in the Appendix to this Order shall be followed in this proceeding. a. Responses to requests for information shall be appropriately bound, tabbed, and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided, with copies to all parties of record, and the original and 10 copies to the Commission. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person's knowledge, information, and belief formed after a reasonable inquiry. c.
