Order Entered: 1. Kentucky-American's petition for confidential protection for all paper and electronic diagrams and maps of Kentucky-American's water distribution system submitted with its application is granted. 2. The designated material shall not be placed in the public record or made available for public inspection until further Orders of this Commission. 3. Use of the material in question in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. Kentucky-American shall inform the Commission if the material in question becomes publicly available or no longer qualifies for confidential treatment. 5. If a non-party to this proceeding requests to inspect the material granted confidential treatment by this Order, Kentucky-American shall have 30 days from receipt of written notice of the request to demonstrate that the material still falls within the exclusions from disclosure requirements established in KRS 61.878. If Kentucky-American is unable to make such demonstration, the requested material shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the requested material available for inspection for 30 days following an Order finding that the material no longer qualifies for confidential treatment in order to allow Kentucky-American to seek a remedy afforded by law.

The materials contained in KAWC's response to Staff's First Request, Items 12, 13, 15, and 17, are hereby granted confidential protection and will not be placed in the public record or made available for public inspection for a period of three years from the date of this Order, or upon further Orders of this Commission. 3. The materials contained in KAWC's Response to Staffs Second Request, item 4, meets the criteria for confidential protection as set forth in KRS 61.878(1)(m)1 .f, and is hereby granted confidential protection. Order Entered: Kentucky-American is granted a CPCN to proceed with the proposed construction as set forth in its Application. 2. Kentucky-American shall notify the Commission prior to performing any additional construction not expressly authorized by this Order. 3. Any deviation from the construction approved shall be undertaken only with the prior approval of the Commission. 4. Kentucky-American shall file with the Commission documentation of the total costs of this project, including the cost of construction and all other capitalized costs, (e.g., engineering, legal, administrative) within 60 days of the date that construction is substantially completed. Construction costs shall be classified into appropriate plant accounts in accordance with the Uniform System of Accounts for water utilities prescribed by the Commission. 5. Kentucky-American shall file a copy of the "as-built" drawings and a certified statement that the construction has been satisfactorily completed in accordance with the contract plans and specifications within 60 days of the substantial completion of the construction certificated herein. 6. Kentucky-American shall require construction to be inspected under the general supervision of a licensed professional engineer with a Kentucky registration in civil or mechanical engineering to ensure that the construction work is done in accordance with the contract drawings and specifications and in conformance with the best practices of the cons
