Final Order Entered: 1. This case is opened to address certain outstanding petitions for confidential treatment. 2. The petitions for confidential treatment listed in Appendix B to this Order are granted. 3. The granting of these petitions shall not be cited as precedent in other proceedings before the Commission. 4. All movants shall review the petitions to determine if the material for which confidential treatment was requested still warrants confidential treatment. 5. A movant shall inform the Commission in writing, and filed in the original case file, if it determines that the information contained in a petition that is granted by this Order no longer warrants confidential treatment. 6. The Commission shall make available for inspection, upon request, any materials that a movant determines no longer warrants confidential treatment. 7. Order Entered: The Commission's January 30, 2015 Order in this proceeding is affirmed and Duke Kentucky's Petition is denied. 2. Duke Kentucky's Motion for Informal Conference is denied as moot. 3. For any expense month in which Duke Kentucky excludes power purchase in excess of its highest-cost generating unit from the FAC, it shall include in the FAC Supplemental Schedules for that expense month, documentation showing the amounts excluded and the calculation of those amounts. |

Order Entered: 1. Purchase power costs of $11,787 shall be disallowed for recovery in Duke Kentucky's upcoming two-year review proceeding covering period November 1, 2012 through October 31, 2014. 2. Duke Kentucky shall immediately begin limiting recovery of purchased power costs through FAC, excluding power purchases made to substitute for a forced outage, to fuel cost of its highest-cost generating unit available to be dispatched to serve native load during the reporting expense month. 3. Power purchases in excess of the fuel cost of its highest-cost generating unit available to be dispatched to serve native load during reporting expense month that have been recovered through Duke Kentucky's FAC since the end of the review period shall be disallowed in future FAC review proceedings. 4. The issue of RTO billing codes & appropriateness of their inclusion in FAC calculation shall be examined in next FAC review proceedings covering two-year period November 1, 2012, through October 31, 2014, for those electric utilities that are members of an RTO. 5. Duke Kentucky shall file testimony in next FAC review proceeding on which codes are included in FAC calculation and an explanation for why each is appropriate for inclusion, subject to recovery limitation discussed in this Order. 6. Except for issue of which RTO billing codes are appropriate for inclusion in FAC, charges and credits billed by Duke Kentucky through FAC for period November 1, 2013 through April 30, 2014 are approved. |

Order Entered: (1) Duke Kentucky shall appear in HR 1 on November 12, 2014 at 10:00 a.m., EST, to submit itself to examination of the application of the Fuel Adjustment Clause of Duke Kentucky from November 1, 2013, through April 30, 2014. Neither opening statements nor summaries of pre-filed testimony will be permitted. (2) Not less than seven days and no more than 21 days prior to hearing, Duke Kentucky shall publish notice of the purpose, time, place, and date of the hearing. (3) Duke Kentucky shall file no later than November 7, 2014 proof of publication of its notice for the hearing. (4) The official record of the proceeding shall be by video only. (5)The information requested in the Appendix is due not later than 14 days from the date of this Order. (6) Any party which wishes to file testimony or requests information from Duke Kentucky may petition the Commission for a procedural schedule. (7) Any request for intervention must be filed by September 8, 2014. (8) A person who submits a motion to intervene after September 8, 2014, and, upon a showing of good cause, is granted full intervention shall accept and abide by the existing procedural schedule. |
