Final Order Entered: 1. This case is opened to address certain outstanding petitions for confidential treatment. 2. The petitions for confidential treatment listed in Appendix B to this Order are granted. 3. The granting of these petitions shall not be cited as precedent in other proceedings before the Commission. 4. All movants shall review the petitions to determine if the material for which confidential treatment was requested still warrants confidential treatment. 5. A movant shall inform the Commission in writing, and filed in the original case file, if it determines that the information contained in a petition that is granted by this Order no longer warrants confidential treatment. 6. The Commission shall make available for inspection, upon request, any materials that a movant determines no longer warrants confidential treatment. 7. This case is closed and removed from the Commission's docket. |

Order Entered: 1. Kentucky Power's August 27, 2014 petition for confidential protection is denied as moot. 2. Within 30 days of the date of this Order, Kentucky Power shall file revised pages reflecting as unredacted the designated materials subject to the August 27, 2014 petition that has been denied confidential treatment. 3. The designated materials in the August 27, 2014 petition for which confidential protection was denied shall not be placed in the public record for 30 days following the date of this Order to allow Kentucky Power to seek any remedy afforded by law. |

Order Entered: 1. Kentucky Power's October 1, 2014 petition for confidential protection is granted. 2. The designated materials shall not be placed in the public record or made available for public inspection for an indefinite period, or until further Orders of this Commission. 3. Use of the designated materials in any Commission proceeding shall be in compliance with 807 KAR 5:001, Section 13(9). 4. Kentucky Power shall inform the Commission if the designated materials become publicly available or no longer qualify for confidential treatment. 5. If a non-party to this proceeding requests to inspect the designated materials granted confidential treatment by this Order and the period during which the materials have been granted confidential treatment has not expired, Kentucky Power shall have 30 days from receipt of written notice of the request to demonstrate that the materials still fall within the exclusions from disclosure requirements established in KRS 61.878. If Kentucky Power is unable to make such demonstration, the requested materials shall be made available for inspection. Otherwise, the Commission shall deny the request for inspection. 6. The Commission shall not make the designated materials available for inspection for 30 days following an Order finding that the materials no longer qualify for confidential treatment in order to allow Kentucky Power to seek a remedy afforded by law. |

Final Order Entered: 1. One hundred percent of Kentucky Power's share of Mitchell "no load costs" incurred during the Overlap Period is disallowed for recovery. 2. For the four months of the Overlap Period that fall in the review period, January 2014 through April 2014, the amount of the disallowance for Mitchell "no load costs" is $13,155,170.15. 3. Power purchases in the amount of $83,720.76 that were in excess of the Peaking Unit Equivalent are disallowed for recovery during the review period. 4. Beginning with its first FAC filing made subsequent to the date of this Order, or as amended if filed prior to the date of this Order, and continuing for a total of four consecutive months, Kentucky Power shall include a credit of $3,309,722.7331 to refund to customers a total of $13,238,890.91 for power purchases in excess of the Peaking Equivalent Unit and Mitchell "no load costs" during the period under review as discussed herein. 5. Kentucky Power shall cease collecting through the FAC "no load costs" related to the Mitchell Station. This cessation shall continue through the end of the Overlap Period, May 31 , 2015. 6. Mitchell "no load costs" that Kentucky Power has recovered through the FAC since the end of the review period shall be disallowed in future FAC review proceedings. |

Order Entered: (1) Kentucky Power shall appear in HR 1 on November 12, 2014 at 10:00 a.m., EST, to submit itself to examination of the application of the Fuel Adjustment Clause of Kentucky Power from November 1, 2013, through April 30, 2014. Neither opening statements nor summaries of pre-filed testimony will be permitted. (2) Not less than seven days and no more than 21 days prior to hearing, Kentucky Power shall publish notice of the purpose, time, place, and date of the hearing. (3) Kentucky Power shall file no later than November 7, 2014 proof of publication of its notice for the hearing. (4) The official record of the proceeding shall be by video only. (5)The information requested in the Appendix is due not later than 14 days from the date of this Order. (6) Any party which wishes to file testimony or requests information from Kentucky Power may petition the Commission for a procedural schedule. (7) Any request for intervention must be filed by September 8, 2014. (8) A person who submits a motion to intervene after September 8, 2014, and, upon a showing of good cause, is granted full intervention shall accept and abide by the existing procedural schedule. |
