Final Order Entered: (1) Henderson District shall, for accounting and ratemaking purposes, use the "PSC Approved Service Life" set forth in Appendix B to this Order for the listed classes of assets when calculating and reporting depreciation for all reporting periods after the date of this Order, but shall make no retroactive adjustment to its books to account for the cumulative effect of this change in accounting estimate. (2) Henderson District's proposed rates, as revised in its Response to the Commission's Order of August 27, 2013, are approved. (3) Henderson District shall charge the rates that are set forth in Appendix C for service rendered on and after the date of this Order up to and including November 14, 2014. (4) Henderson District shall charge the rates that are set forth in Appendix D for service rendered on and after November 15, 2014. (5) No earlier than 30 days but no later than 20 days prior to November 15, 2014, Henderson District shall publish notice of the Phase II rates at least once in a newspaper of general circulation in its territory and shall file with the Commission proof of publication of such notice no later than ten days after publication of notice. (6) Within 20 days of the date of this Order Henderson District shall file revised tariff sheets that contain the rates approved in this Order. (7) Within 90 days, Henderson District shall revise its internal controls to establish work order system that complies with the uniform System of Accounts

Order Entered: 1. Henderson County District shall publish notice of the revised request in a newspaper of general circulation in its territory no later than September 25, 2013 and shall provide the Commission with proof of publication of such notice no later than October 2, 2013. Notice shall be in the format set forth in the Appendix to this Order. 2. The informal conference scheduled in this matter for September 17, 2013 is cancelled. 3. The hearing in this matter scheduled for October 15, 2013 is cancelled. 4. On October 15, 2013, this case shall stand submitted for a decision.

Order Entered: 1. Henderson District shall file with the Commission no later than 8/29/13: a. Its written comments on and any objections to the findings and recommendations contained in the Commission Staff Report; b. Written notice of its position on adjusting its general rates for water service to a level that will produce $3,041,033 from water sales; c. Written notice of its position on changing the service lives of certain water assets to the service lives that Commission Staff has recommended; d. Any additional evidence for the Commission's consideration; e. Written notice as to whether this matter may be submitted for decision based upon the existing record without hearing. 2. Henderson District's failure to file with the Commission written objections to a finding or recommendation contained in the Commission Staff Report by 8/29/13 shall be deemed as agreement with that finding or recommendation and a waiver of any right to object to that finding or recommendation. 3. If Henderson District wishes to revise its proposed rates for water service to the levels that Commission Staff recommended, Henderson District shall file a revised request for rate adjustment with its response to the Commission Staff Report. 4. If Henderson District revises its request for rate adjustment, it shall publish notice in a newspaper of general circulation in its territory no later than 9/9/13, and provide the Commission with proof of publication of notice no later than 9/20/13.

Notice of Filing of Commission Staff Report

Order Entered: 1. Unless all parties request that this mailer be submitted for decision upon the existing record, a formal hearing in this mailer shall be held on October 15, 2013 at 10:00 a.m. Eastern Daylight Time in Heating Room I of the Commission’s offices at 211 Sower Boulevard, Frankfort, Kentucky. 2. Henderson County Water District shall publish notice of the scheduled hearing in accordance with 807 KAR 5:076, Section 11, no more than 21 days and no less than seven days before the day of the scheduled hearing. 3. Pursuant to KRS 278.360 and 807 KAR 5:001, Section 9(9)(a), the record of the formal hearing in this mailer shall be by videotape. 4. Commission Staff shall prepare a written list of all exhibits presented at the hearing and shall file this list with the Commission with all hearing exhibits and a copy of the video transcript of the hearing. 5. Any request to cancel or postpone this hearing shall be made by motion filed with the Commission at least one week before the hearing is scheduled to commence. 6. Pursuant to KRS 278.080, James Wood is designated as hearing officer to conduct the scheduled hearing in this matter.

Order Entered: 1. No later than August 15, 2013, Commission Staff shall file with the Commission and serve upon all parties of record a written report containing its findings and recommendations regarding Henderson District’s requested rate adjustment. 2. No later than August 29, 2013, or 14 days after the date of the filing of the Commission Staff Report, whichever occurs earlier, each party of record shall file with the Commission: a. Its written comments on and any objections to the findings and recommendations contained in the Commission Staff Report; b. Any additional evidence for the Commission’s consideration; and, c. Written notice as to whether this matter may be submitted for decision based upon the existing record without hearing. 3. If Commission Staff finds that Henderson District’s financial condition supports a higher rate than Henderson District proposes, or the assessment of an additional rate or charge not proposed in Henderson District’s application, Henderson District in its response to the Commission Staff Report shall also state its position in writing on whether the Commission should authorize the assessment of the higher rate or the recommended additional rate or charge.
