Order Entered: (1) The findings and recommendations contained in Commission Staff's report are adopted and incorporated by reference into this Order as if fully set out herein. (2) Southeast Daviess District's proposed rates are denied. (3) The rates set forth in the Appendix to this Order are approved for water service that Southeast Daviess District renders on and after the date of this Order. (4) Within 20 days of the date of this Order, Southeast Daviess District shall file a revised tariff sheet with the Commission. (5) The informal conference and hearing scheduled in this matter are cancelled. (6) This matter is closed and shall be removed from the Commission's docket.

Order Entered: (1) This proceeding is established to review the reasonableness of Southeast Daviess District's proposed rates. (2) No later than January 30, 2012, Commission Staff shall file with the Commission and serve all parties a written report containing its findings and recommendations. (3) Parties shall file with the Commission written comments and any objections to the findings and recommendations no later than February 13, 2012 or 14 days after the date of the filing of the Commission Staff Report. (4) A party's failure to file written objections shall be deemed as agreement with that finding or recommendation. (5) Each party shall notify the Commission in writing if this matter may be submitted for decision based on existing record without hearing. (6) Unless all parties request that this matter be submitted for decision upon the existing record, an informal conference shall be held on March 1, 2012 at 1:30. (7) Unless all parties request this matter be submitted for decision upon the existing record, a formal hearing shall be held in the Commission's offices at a date and time to be announced. (8) Each party shall file with the Commission a list of the persons it intends to call as witnesses at the hearing. (9) Southeast Daviess District shall publish notice of the hearing. (10) The record on the formal hearing shall be by video tape. (11) Commission Staff shall make a written exhibit list and shall file this list.
