Order Entered 1. Except where they contradict or conflict with the findings contained in this Order, the findings contained in Commission Staffs report are adopted and incorporated by reference into this Order as if fully set out herein. 2. The rates set forth in Appendix A to this Order are approved for water service that Gallatin District renders on and after the date of this Order. 3. The rates set forth in Appendix B to this Order are approved for water service that Gallatin District renders on and after November 1, 2013. 4. Within 20 days of the date of this Order, Gallatin District shall file revised tariff sheets with the Commission setting forth the rates approved in this Order. 5. This matter is closed and shall be removed from the Commission’s docket.

Order Entered: 1. No later than February 27, 2012, Commission Staff shall file a report containing its findings and recommendations. 2. The parties shall file with the Commission written comments and objections to the findings and recommendations no later than March 12, 2012. 3. A party’s failure to file written objections to a finding or recommendation by March 12, 2012, shall be deemed as agreement with that finding or recommendation. 4. No later than March 12, 2012, each party shall notify the Commission whether this matter may be submitted for decision based upon the existing record and without hearing. 5. Unless all parties request that this matter be submitted for decision, an informal conference shall be held on March 20, 2012 at 10:00 a.m.at the Commission’s offices. 6. Unless all parties request that this matter be submitted for decision upon the existing record, a formal hearing shall be held on April 10, 2012, beginning at 1O:OO a.m., in Hearing Room 1 of the Commission’s offices. 7. Each party shall file with the Commission, no later than March 27, 2012, a list of the persons it intends to call as witnesses and a summary of each witness’s expected testimony. 8. Gallatin shall publish notice of the hearing no fewer than seven and no more than 21 days prior to the hearing. 9. All provisions of the Commission’s Order of October 21, 2011 that conflict with the provisions of this Order are vacated. All remaining provisions shall remain in full force.

COMMlSSlON STAFF’S FIRST REQUEST FOR INFORMATION TO GALLATIN COUNTY WATER DISTRICT

Order Entered: (1) This proceeding is established to investigate the reasonableness of Gallatin District's proposed rates. (2) Gallatin District shall not place its proposed rates into effect until complying with the provisions of KRS 278.180 and 807 KAR 5:011, Sections 6 and 9. (3) No later than January 17, 2012, Commission Staff shall file with the Commission a report containing its findings and recommendations on Gallatin District‘s application. (4) The parties shall file written comments on and any objections to the findings and recommendations contained in the Commission Staff Report no later than January 30, 2012, or 14 days after the date of the filing of the Commission Staff Report. (5) A party’s failure to file written objections to a finding or recommendation contained in the Staff Report shall be deemed as agreement with that finding or recommendation. (6) No later than January 30, 2012, or 14 days after the date of the filing of Staff Report, each party shall notify the Commission in writing whether this matter may be submitted for decision based upon the existing record and without hearing. (7) Unless all parties request that this matter be submitted for decision upon the existing record, an informal conference shall be held in this matter on February 6, 2012 at 10:00 a.m. EST. (8) Unless all parties request that this matter be submitted for decision upon the existing record, a formal hearing in this matter shall be held on February 22, 2012 at 9:OO a.m., EST.
