Final Order Entered: (1) Red Barn is assessed a penalty of $2,500 for its willful failure to comply with KRS 278.140 and KRS 278.230(3). (2) Red Barn shall pay the assessed penalty within 14 days of the date of this Order. Payment shall be made by certified check or money order made payable to "Kentucky State Treasurer" and shall be mailed or delivered to the Office of General Counsel, Kentucky Public Service Commission, 211 Sower Boulevard, P. 0. Box 615, Frankfort, Kentucky 40602-0615. (3) Within 20 days of the date of this Order, Red Barn shall file with the Commission completed sewer annual financial and statistical reports for its 2008, 2009, and 2010 calendar year operations and completed reports of gross earnings derived from intrastate business for its 2008, 2009, and 2010 calendar year operations.

Order Entered: (1) Red Barn Waste shall file with the Commission, no later than October 20, 2011, its annual reports and gross operating reports for the 2009 and 2010 calendar years. (2) Red Barn Waste shall appear on October 27, 2011 at 10:00 a.m. in Hearing Room 1 of the Commission's offices for the purpose of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with KRS 278.140 and 278.230(3). (3) If Red Barn Waste desires to waive its right to a hearing in this matter, it shall, no later than October 20, 2011 file the required reports and pay a penalty of $250.
