Order Entered: Estill District’s Motion is granted. 2. Estill District is granted an extension of time up to and including November 30, 201 1 to file its required financial and statistical reports for calendar year 2010. Estill District is assessed a civil penalty of $250. Payment of the penalty shall be made no later than November 30,2011 by certified check or money order made payable to the Treasurer, Commonwealth of Kentucky, and shall be delivered to the Office of General Counsel, Public Service Commission, 211 Sower Boulevard, P.O. Box 61 5, Frankfort, Kentucky 40602-061 5. 5. Estill District’s failure to file the required reports and submit the required civil penalty within the time period specified by this Order will subject it to additional civil penalties.

Response of Estill County WD No 1 to Order of Oct 11, 2011, Waiver of Hearing, and motion for extension of time within which to file required reports

Order Entered: Estill County Water shall file with the Commission, no later than October 20, 201 1, its water district and sewer annual reports for the 201 0 calendar year. 2. Estill County Water shall appear on October 27,201 1, at 1O:OO a.m., Eastern Daylight Time, in Hearing Room 1 of the Commission’s offices at 21 I Sower Boulevard, Frankfort, Kentucky, for the purpose of showing cause why it should not be subjected to the penalties of KRS 278.990 for its failure to comply with 278.230(3). 3. If Estill County Water desires to waive its right to a hearing in this matter, it shall, no later than October 20, 201 1 , file the required reports and pay a penalty of $250. Payment of the penalty shall be made by certified check or money order made payable to the Treasurer, Commonwealth of Kentucky, and shall be delivered to the Office of General Counsel, Public Service Commission, 21 1 Sower Boulevard, P.O. Box 61 5, Frankfort, Kentucky 40602-0615.
