Order Entered: (1) The Commission’s Order entered on January 31, 2012 is amended as follows: a. At page 4, under the heading “Allocation of Roll-In,” the third sentence is corrected by deleting the reference to “$49,410,832 total roll-in” and substituting in its place "$161, 413,973 roll-in;” b. At page 5, the first complete sentence on the page is corrected by deleting the reference to “the roll-in of $49,410,832” and substituting in its place “the roll-in of $161,413,973;” and c. In ordering paragraph No. 3, the second sentence is corrected by adding the word “total” so the sentence reads, “[the total roll-in shall be allocated to the customer classes as described in the Settlement Agreement approved in Case No. 2011-00161." (2) All other provisions of the Commission’s January 31, 2012 Order shall remain in full force and effect. (3) KU's proposed revisions and modifications to its monthly ES Forms 1.00, 1.10 , and 3.00 as filed on February 23, 2012 are approved effective with the date of this Order.

Order Entered: KU’s request to submit this case for a decision on the existing evidence of record without a hearing is granted. KU’s Response to Commission Staff’s First Request for Information, Appendix B, Item 6” 2. KU shall include a $596,811 monthly decrease in its jurisdictional environmental revenue requirement determined in the first four months and a $596,812 decrease in the next two months, beginning in the second full billing month following the month in which the Commission issues its Final Order in this proceeding. 3. KU shall roll $49,410,832 into its existing base rates in environmental surcharge amounts found to be just and reasonable herein. The roll-in shall be allocated to the customer classes as described in the Settlement Agreement approved in Case No. 201 1-00161" 4. For the 2005, 2006, and 2009 Compliance Plans, KU shall use an overall rate of return on capital of 7.43 percent, a tax gross-up factor of 0.56, a return-on-equity rate of 10.63 percent and an overall grossed-up return of 10.56 percent in all monthly environmental surcharge filings subsequent to the date of this Order. 5. For the 201 1 Compliance Plan, KU shall calculate an overall rate of return on capital using a return-on-equity rate of 10.1 percent for all projects included in the 2011 Compliance Plan in all monthly environmental surcharge filings subsequent to the date of this Order. 6. Order Entered: 1. The procedural schedule set forth in Appendix A, attached hereto and incorporated herein, shall be followed 2. KU shall appear at the Commission’s offices on the date set forth in Appendix A to submit itself to examination on the application of its environmental surcharge as billed to consumers from May 1, 2009 through April 30, 2011. At the public hearing there shall be no opening statements or summaries of testimony. 3. KU shall, by the date set forth in Appendix A, file its prepared direct testimony in support of the reasonableness of the application of its environmental surcharge mechanism during the period under review. Any party filing testimony shall file an original and ten copies. a. The information requested herein is due on or before the date set forth in Appendix A. Responses to requests for information shall be appropriately bound, tabbed and indexed and shall include the name of the witness responsible for responding to the questions related to the information provided, with copies to all parties of record and seven copies to the Commission. b. Each response shall be answered under oath or, for representatives of a public or private corporation or a partnership or association or a governmental agency, be accompanied by a signed certification of the preparer or person supervising the preparation of the response on behalf of the entity that the response is true and accurate to the best of that person’s knowledge, information, and belief formed
