The rates set forth in the Appendix attached hereto are approved for service rendered on and after September 1, 2011. 3. Within 20 days of the date of this Order, Meade shall file with this Commission, using the Commission’s electronic Tariff Filing System, its revised tariff sheets setting out the rates approved herein and stating that they were approved pursuant to this Order. 4. Order Entered: The proposed rates submitted with Meade County’s application are rejected. The approach proposed by Meade County to allocate its portion of the increase in wholesale rates authorized in Case No. 2011-00036 is accepted. The rates set forth in the tariff sheets in the Appendix hereto are approved for service rendered on and after September 1, 2011. Meade County’s revised proposed Non-FAC PPA tariff, modified as set out in this Order, is approved. Within 20 days of the date of this Order, Meade County shall file its revised tariffs with this Commission setting out the rates approved herein and stating that they were approved pursuant to this Order. Within 60 days of the date of this Order, Meade County shall refund to its customers with interest all amounts collected for service rendered from September 1, 2011 through the date of this Order that are in excess of the rates set forth in the Appendix to this Order. Meade County shall pay interest on the refunded amounts at the average of the Three-Month Commercial Paper Rate as reported in the Federal Reserve Bulletin -4- Case No. 2011-00038 and the Federal Reserve Statistical Release on the date of this Order. Refunds shall be based on each customer's usage while the proposed rates were in effect and shall be made as a one-time credit to the bills of current customers and by check to customers who have discontinued service since September 1,2011. Order Entered: (1) Meade County shall publish notice of its proposed pass-through of Big Rivers' wholesale rates in a newspaper of general circulation in each of its service territories of Hancock and Hardin counties in newspapers that qualify under KRS 424.120. (2) Meade County shall file with the Commission no later than 15 days following publication as Ordered herein, proof of publication of its proposed pass-through of Big Rivers' wholesale rates. Order Entered: (1) Meade's proposed rates are suspended up to and including August 31, 2011 in order to match the suspension period of Big Rivers' proposed wholesale rate increase. (2) The procedural schedule set forth in the Appendix shall be followed. (3) a. All requests for information and responses shall be appropriately bound. (3) b. Each response shall be answered under oath. (3) c. A party shall make timely amendment to any prior response if the response was incorrect when made. (3) d. Any request a party fails to furnish the requested information, that party shall provide a written explanation. (4) Any party filing testimony shall file an original and 10 copies with the Commission with copies to all parties of record. (5) Meade shall give notice of the hearing in accordance with the provisions set out in 807 KAR 5:011, Section 8(5). (6) At any public hearing, neither opening statements nor summarization of direct testimony shall be permitted. (7) Any objections shall be filed upon four business days' notice. (8) Motions for extensions of time shall be made in writing. (9) Nothing contained herein shall prevent the Commission from entering further Orders in this matter. |
